I'm pretty sure most online sales are supposed to include sales tax after Jan 1 2019. It's generally more dependent on where the buyer lives rather than the seller.

I had some prints up for auction on ebay in Feb and the Washington resident that won was more than a little shocked when he was charged 10% sales tax.
I'm not someone else.

Not really. It matters where the seller is based and what the (new) laws of the state you are selling to are post the South Dakota vs Wayfair decision. In general, many states have said that if you do 100k in sales or 200 transactions within a state in a year, you are required to collect sales tax for that state. However, a lot of states still don't have an official policy or it hasn't gone into effect yet.

Afaik he ships from California and I live in Texas, I looked around and there is nothing I can find about that being legal. I wonder where he plans to send the tax revenue too or maybe he just pockets it for spending money? lol

It looks like it's required if he does 500k in transactions a year in Tejas, which I highly doubt he does. Even if he doesn't, see below:

P.S. It wouldn't surprise me if some of the e-commerce platforms like shopify and bigcartel start facilitating the tracking and remittance of out of state taxes (if they aren't already).
