The easy way to get a chargeback…
1). Call up your credit card company and speak to a representative that can handle chargebacks.
2). Tell them you purchased goods on March from OddCityEntertainment (check your CC statement and give them the dates/totals).
3). Tell them despite the goods being marked shipped immediately, they were never really shipped. Also, the estimated delivery date was marked for May.
4). Tell them that OddCity has been scamming people, and you know for a fact that numerous people have called their credit card companies about OCE.
5). Tell them you have spoken with the seller, and he has not shipped your print or provided any proof.

That should be it. Get your money back, and let the credit card companies deal with Roman. And keep in mind everyone, just because you got your money back, doesn't mean you can't enjoy this thread.

exactly, what I did! I have all the supporting docs I need. I have my correspondence with Roman, as well. Plus, the forums will be an excellent element of support, too.

But that's a federal crime and you would have to convince a US Attorney to prosecute the case. I'm afraid they have bigger fish to fry. ;)
perhaps, but I know for a fact that eBay has contacted local authorities in instances of both mail & wire fraud....
Consider the statutory definition of Mail Fraud:

"In the United States, mail and wire fraud is any fraudulent scheme to intentionally deprive another of property or honest services via mail or wire communication."

Note that term "intentionally." Do you believe that Roman purposefully took all of these orders with the intention of defrauding everyone and stealing their money? Even if you assert that, it would be all but impossible to prove.

It is more likely that Roman fully intended from the start to fill every order but then had various setbacks or otherwise got in over his head. He should have known better. But that is negligence - not an intentional act. Thus, these delays would almost certainly not fall under the federal law covering Mail Fraud.

My purpose was to deescalate all of the lawsuit nonsense. I hope it didn't backfire on me as usual. :)

I'm done. The only questions left for me is, who do I send the bill too? ;)

Roman. Just make sure it goes through the new post office, not the awful one that caused all this mess to begin with

Firstly, thanks everyone for the entertainment. Also for reminding me that I still haven't received this, despite getting an email saying that they were held up in customs, blah blah blah. And called Amex for my $$ back. It's been 6 month, crazy :hanging:

Lawyered. So most likely Roman is going to have to pay all the credit card companies back due to all the chargebacks?
