I don't believe that suit had been "reported" at the time of bid tendering. With that said, a suit involving fees is not that unusual. Coca Cola, Inc., The Home Depot, Inc., etc., have all been sued over fees. However, that doesn't mean I wouldn't conduct business with them, if given the opportunity.
