What to do...
In February I purchased an item on Ebay from an EB member.
The print arrived creased in 3 places with no visible damage to the mailing tube.
I did not get insurance because the item was under $100 and the seller mentioned packing it in a sturdy tube.
I returned the item to the seller in accordance with their policy for a refund.
The seller claimed that they would not be responsible for the damage, denied me a full refund, and mailed the item back to me a second time.
After numerous emails the seller agreed in writing to give me a partial refund once I received the item.
Delivery confirmation stated that I received the item.
A week went by with no response from the seller.
I filed a paypal claim and the seller responded, disputing it.
I told the seller that I would cancel my paypal claim and still leave positive ebay feedback if they would stick to their word and send the partial refund.
It has been a month since I purchased the item, a dozen emails have been written and I have not received a partial refund.
I'm getting jerked around with short email responses that don't address the problem.
This seller has been dishonest all along, won't take any responsibility and will not do what they say they are going to do via email.
I really hate to give negative ebay feedback because I know that it may effect their sales.
I realize that I should have added insurance, but given that, what recourse do I have at this point to try to get at least some money back.

A Paypal dispute is pretty much your only recourse at this point if the seller is refusing to give you any money back. I don't think Paypal really gives a fudge as long as you get "something". And, I dont really want to state the seller publicly here out of respect to them. Suffice it to say that they are a 700+ point member.
Although maybe it would help them be more accountable for what they said they would do.

Not taking any sides but did you attempt to contact the seller prior to returning the print to him?
Lesson learned dude. Buy insurance. I mandate it on anything I trade or sell for this exact reason.

Right. I only filed a paypal claim because the seller said they would give a partial refund and then did not, without confirming delivery back to me. More runaround.
And, I stated that I would cancel my claim after the partial refund was posted to paypal.
If people would just do what the say they are going to do, without stipulations after the fact, there would be no problem here.

And, yes I contacted the sender before returning the item. They asked for photos, which I was not able to supply. I sent the item back with original packaging for proof, double packed in accordance with their return policy.
Btw, I have 100% positive feedback on ebay.

I believe you have 45 days to submit a Paypal claim. If the time is not up, then re-submit it. Send an email to the guy and let him know you re-submitted it because you are only getting cryptic responses from him, and you need to protect yourself. You will drop the claim, only after he fulfills his side of the deal. Either way it's win-win for you.

Why couldn't you supply photos? No camera? How about borrowing one? I'm not sure that "insurance" is a guarantee of anything especially with foreign transactions. If you purchase insurance on a poster, and the seller refuses to file the insurance claim I think you're SOL but I might be wrong.

if anyone ever screws me over, i'll gladly call them out. i would have to exhaust all other options first. some people just deserve it, some don't, so be sure you know who you're calling out and what there history is. sometimes sh*t just happens. even with people you really trust, or even friends. i've never thought this way unti i recently ran through a bad spell on sellers. paypal sucks for sellers, but it's pretty sweet for buyers. same goes for feedback on ebay. i won't hesitate to leave negative feedback. i don't sell on ebay, so why should i care?
