Perhaps before buying any print, the buyer should request actual photos of said poster.

^ This. I would happily take a partial refund and move on with it. Still perfectly frameable and if you get say 20% refunded, you get it for a great price.

That sure looks like some kind of water damage. :/

I can understand not freaking out over a bump or a hard to see roll bend but a stain or a tear? No, with obvious damage like that, it's the fact that the seller actively tried to deceive the buyer. Doesn't matter if it's minor if the damage represents the time you got screwed.

I will not go on my 'mint' rant again, although the rant is now circling inside my brain, but it is absolute bullshit that this guy can get away with this fraud. I do not trust a single human being that calls any poster "mint", because I know there is absolutely no such thing and said person is more than likely a complete imbecile and/or douche, but why can't the OP win the claim for item is not as described? I have never tried with artwork, but did with electronics and after first claiming that it was sent in working condition (same exact excuse the OP's seller is proclaiming), I filed a claim and threatened the guy with IOC and contacting his local police department as well, and he subsequently refunded me the money.

That's true when the transaction occurs outside of Ebay, but on Ebay the buyer wins almost all the time. Although in this case, a lay person may not agree that the poster is "significantly not as described". Not to mention the OP can always leave negative feedback.

I disagree. I use ebay a lot and I've never seen a seller win as long as the buyer's story is somewhat credible. Put in the SNAD, wait 2 weeks and ebay will tell you to ship it back to the seller, regardless of whether the seller wants it back or not. Give ebay the tracking number and you will receive a full refund (minus the return shipping). I don't usually put in negative feedbacks, but if he was an ass about it, leave one too, I'm pretty sure sellers can't leave negative or even neutral feedbacks anymore.

Sellers cannot leave anything other than positive feedback. NOTE: if you have a really sour deal/experience with a douche, you may want to add them to the exclusion list so they do not win one of your listings just to leave negative feedback (if you also sell). Also note, eBay gave me eBay bucks certificate to encourage me to keep buying there after my bad seller experience, so your return shipping costs may be covered and then some (not with a print though, probably). I used free stamps.com trial postage too so in the end it was a slight money maker. I leave negative feedback.

unless things have changed recently my experience is the opposite. I have used ebay since the 90s, i used to buy/sell fudge ton on there, my feedback is over 2000. I've had my share of claims with them, I have never won a not as decribed claim when it came to cosmetic condition, I even lost a claim when I purchased a shirt labeled as a medium and it arrived being an XL but with no tag (i provided photographs and charts of basic shirt measurements showing that it was way too oversized to be a medium.) lost that claim.

if were talking electronics like someone else brought up, there is a difference between cosmetic condition and working condition, if it doesn't work, you can win the claim (almost better to file a cosmetic claim as a broken claim just so ebay will let you return it for a refund.) but when it comes to a poster, there are only two things... is it authetic and is it in the described condition, ebay isn't really up to making these decisions and in my past experiences have always sided with the seller, but hey, i hardly buy stuff off ebay these days (i don't collect anything other than records here an there) so maybe it's changed to the buyers favor.

Ahh, you're probably right then, 90% of my purchases are probably electronics, especially the ones that I have to submit a SNAD and I haven't lost one yet. Guess I just figured it was the same across all categories.

same EXACT thing happened to me when i bought a total recall off of ebay. the seller sent it to me in the skinniest tube I've ever seen. and he had to crunch the hell out of the print to get it in that tube. full of bends, creases, tears etc. i hit the guy up sent him pictures and threatened i'd file a paypal claim..he had me return it and refunded my money. i later found a friend on EB with one for sale and i was happy in the end. just a massive headache. hopefully you get sorted out.

i've had this happen about 3 times now and starting from last week whenever i buy a print off ebay i will always include my experiences with these tubes and the seller should use at least a 3" tube to reduce the chance of hardcore roll waves and creases. the last one i got has hard roll marks and quite a few creases, it sucks to see what was a beautiful and great condition print all mangled
