Ebay/Paypal Dispute

Love to hear some thought from experienced ebay/paypal veterans:

I bought 2 Ice Hockey Jerseys from a guy with alst 50,000 feedback.

He charges me almost $40 in S&H, sends them together and cost him less than $20. I'm happy to pay $3-5 for costs, but $20 is not on. That's not the problem though. (I didn't know this until it arrived of course, that's a whole other area Ebay lets you down as a buyer, with only negative feedback as your option)

After a 2 weeks of waiting, I email him, he say that there was some mix up at the warehouse and that they will go out in a day or two.

The jerseys finally arrive (3 weeks after payment) He sends me 1 wrong jersey - right team and size, wrong colour combo (home jersey instead of away one or something like that)

I email me letting him know the goods arrived, but 1 was wrong.

He responds, something like - damn, you're in Australia to, what do you think is fair.

I reply that I already have the Jersey that he sent me in error so it is no good to me,

He responds to send it back.

I ask if he wants it sent back Airmai or Registered Airmail.

He responds Airmail.

I pack the item up, go to the PO and get a quote and email him back. Lett ing him know that I will post it off asap as he send through the postage.

Now the dramas - he starts into this whole - how do I know you'll post it, I have no recourse as a seller, blah blah.

I let him know I have 1500+ feedback, so i'm not a scammer, I paid him postage upfront in good faith, he should do the same, he dropped the ball twice with the delay and the wrong jersey. He should just send out a replacement asap and pay me to return the wrong one.

I file a tentative dispute with Paypal stating all this.

He files an unpaid item dispute with ebay (WTF?)

I reply to the ebay dispute with the Paypal Transaction #s.

I wait a week, nothing, so I escalate it to a full dispute.

He waits until the last minute, responds to Paypal, now being evaluated.

Am I being unreasonable here?

HE filed an unpaid item dispute? Thats bizarre.
If I'm not mistaken, he can't leave neg feedback for you, but he is probably thinking that even if you leave neg feedback for him, it is little more than a blip among his 50000+ feedback.

Sounds like you've been pretty reasonable. The onus is on the seller to make sure you get what you ordered. ANY costs incurred should be at his expense.

I hope ebay/paypal see fit to rule in your favour on this one.

Right on. I just bought Fairey Danzig for a pretty good chunk of change, no contact from seller, just an automated invoice. Crazy if they think I'm just going to send cash with a seller rating of zero. I sent my phone # twice, concerned about shipping methods, and wanted escrow, I got NOTHING for 2 days. Still waiting...

I know the print will simply show up later, cause they got greedy and are trying to duck me. But they don't know what they are dealing with. I have NO life. All I do is work out and hate, I will watch like a hawk.

But of course ebay won't do fudge, even if they use the same damn photo.

Update - this is unbelieveable.

"We have concluded our investigation into your case. Unfortunately, at this
time we are unable to decide this claim in your favour."

U gotta be kidding me right, no explanation, how decision was reached - nuttin!



My Response:

" I was wanting to find out more information on why this claim was not
found in my favour and appeal the decision.

As I understand it, I was sent the wrong item and the seller refused to
pay for the return shipping.

I am at a loss as to what I am supposed to do to get the item replaced. "

All paypal really care is that the seller has sent you something and they can proved it was delivered. It happened to me when I bought a poster and was sent the wrong one. The seller never responded and I opened a claim. It was closed right away and it was in favor of the seller.

When I called they said that delivery was confirmed and that was pretty much good enough for them. I asked him if moving forward I just sent out empty packages with proof of delivery would I would be covered as the seller? There was a good 10 seconds of crickets and he asked me if I had any other questions.
